I. Introduction
1.1. The purpose of these “Terms and Conditions of Events and Contests” is to provide a comprehensive and clear regulation of the terms and conditions of events and contests organized by GTS Alive in the United Arab Emirates (“UAE”).
1.2. Each individual Contest has its own Contest Rules and each Contest may be communicated by GTS Alive using the Abbreviated Rules. The rules for each Contest and the abbreviated version of the rules in promotional materials must be interpreted in accordance with these Terms and Conditions. In the event that a particular condition is regulated differently in these Terms and Conditions than in the Abbreviated Rules, the Abbreviated Rules shall prevail. In the absence of regulation in the Abbreviated Rules, these Terms and Conditions shall apply.
1.3. By submitting an entry, posting a comment, or otherwise acting in accordance with the Rules of a particular Contest, the Contestant enters the Contest, thereby agreeing to these Terms and Conditions, which he/she agrees to abide by without reservation.
1.4. All capitalized terms in these Terms and Conditions have exclusively the meaning as defined in the Definitions provided herein.
1.5. These Terms and Conditions are effective from 1st of December 2023.
II. Definitions
GTS Alive GTS ALIVE ME DMCC, defined as the promoter and organizer in these Terms and Conditions.
Rules “Rules” means the Rules for the use of IDs and cards which can be found here.
Terms and Conditions “Terms and Conditions” means these Terms and Conditions of Events and Contests.
Abbreviated Rules
“Abbreviated Rules” means the specific Terms and Conditions and rules of a particular Contest.
Policy
“Policy” means the Privacy Policy which can be found here.
Business Terms and Conditions
“Business Terms and Conditions” means the Business Terms and Conditions for Online Ordering which can be found here.
Contest
Any Contest or event organized by GTS Alive under these Terms and Conditions.
Contest Entry
Entry, text, photograph, personal participation, or any other performance with which the Contestant participates in the Contest.
Prize
A reward, winnings or voucher that is set as a prize for each individual Contest as detailed in the specific rules of each Contest.

Alive App The name of the mobile application used to display the digital ID/Card or view discounts, contests and other optional features, among other things.
Alive Profile A personal profile of the Holder created to use any product/service provided by GTS Alive.
ID
“ID” means any ISIC, IYTC, ITIC and AliveID-licensed and Alive-licensed ID that may be issued by a university or school, GTS Alive or other authorised distributor.
Card
“Card” means any AliveID membership card issued by GTS Alive or other authorised distributor.
Holder
A user of any ID or Card.
Contestant
A participant in the Contest/event or a person interested in participating in the Contest/event under these Terms and Conditions and the Abbreviated Rules.
III. General provisions
3.1. The promoter and organizer of the Contest is GTS ALIVE ME DMCC, license number: DMCC-073822, with its registered office at DMCC Business Centre, Unit No: 3928, Jewellery & Gemplex 3, Dubai, United Arab Emirates.
3.2. GTS Alive is entitled to entrust third parties with the organisation or other actions.
3.3. The time and place of the Contest shall always be determined by the Abbreviated Rules. Contests may be held on FB, another social network in the Alive App or on the Website in the Alive Profile or elsewhere as set out in the GTS Alive Abbreviated Rules.
IV. Contestant
4.1. Only a natural person over 18 (eighteen) years of age with a delivery address in the UAE may become a Contestant, unless otherwise provided in the Abbreviated Rules.
4.2. Persons under 18 (eighteen) years of age may not participate in the Contest even with the consent of their legal guardian (e.g. parent).
4.3. GTS Alive is entitled to verify this fact at any time and if it finds that such Contestant has not been granted consent by his/her legal guardian, even subsequently, it is entitled to disqualify the Contestant from the Contest without compensation. GTS Alive is also entitled at any time to request the consent of the legal guardian in writing and the Contestant is obliged to provide GTS Alive with such written consent of his/her legal guardian. If the Contestant fails to provide written consent of his/her legal guardian within 4 (four) days of the date of sending the request by GTS Alive (or a person authorised by GTS Alive), the Contestant shall be disqualified from the Contest.
4.4. All persons employed by or in a similar relationship with GTS Alive or collaborating companies or self-employed natural persons, as well as any persons closely related to such persons within the meaning of Federal Law No. 24 of 2006 concerning Consumer Protection and the Federal Law No. (4) of 2012 on the Regulation of Competition, as amended, shall be excluded from the Contest.
4.5. Any persons who do not comply with the terms and conditions of participation in the Contest or who act in contravention of these Terms and Conditions and the rules of a particular Contest shall not be entered in the Contest. Even if such person fulfils some of the terms and conditions for winning the Prize, e.g. as a result of false information provided by him/her, he/she shall not become a winner and shall not be entitled to the Prize. In such case, the Prize shall be forfeited to GTS Alive, which is entitled to decide on its further use.
4.6. The Contestant shall be disqualified if GTS Alive finds or has reasonable grounds to suspect that fraudulent or dishonest conduct has been committed by any of the Contestants or other person who has assisted that Contestant in winning the Prize.
4.7. If the Contest is only organised for a reward for a valid ID holder or Alive Profile user and subscriber of the selected information, that condition must be met for the duration of the Contest until the Prize is handed over. Otherwise, the Contestant shall be disqualified from the Contest or the Prize shall not be handed over.
V. Contest mechanics
5.1. The Contestant shall enter the Contest by complying with the rules under the Abbreviated Rules and these Terms and Conditions.
5.2. The Contest may have knowledge, skill or random mechanics in the Abbreviated Rules.
5.3. In knowledge mechanics, the Contestant shall post a comment with the answer to the question in accordance with the rules of the specific Contest. The question must be answered correctly. If no answer is correct, the closest answer wins. If there are multiple correct answers, the fastest answer wins. If there is no correct answer and there are multiple closest answers, the fastest answer wins. If a decision cannot be made even on the basis of the speed criterion, GTS Alive is entitled to submit a new knowledge question on any topic to determine the winner.
5.4. In skill mechanics, the Contest may be based on speed, sport, creativity or other skill. The mechanics are laid down in the rules of the specific Contest, which also specify what the Contestant must do best and the criteria for determining the winner. Unless otherwise provided, the following rules apply:
5.4.1. in speed mechanics, the task must be completed as quickly as possible;
5.4.2. in sport mechanics, the specified discipline must be won;
5.4.3. in creative mechanics, the funniest and most original answer/entry must be posted. For some questions, the answer may be a video, photograph or plain text answer, depending on the nature of the mechanics; the condition for participation in such cases is the granting of licences pursuant to these Terms and Conditions.
5.5. In random mechanics, the winner shall be determined by drawing lots or by other random means.
5.6. The Contest may also be based on a combination of the above mechanics (e.g. the condition is a correct answer and a specific order that has been set) – such conditions are defined in the Abbreviated Rules. Pursuant to the Abbreviated Rules, the Contest may also be based on other mechanics.
5.7. The Contest may be held on FB. In such case, the Contestant shall enter the Contest by posting the Contest Entry as a comment to the main contest entry published by the Organiser on Facebook. Each Contestant may post no more than one comment from his/her own Facebook profile in the Contest in the form of one Contest Entry. Failure to do so shall result in disqualification from the Contest. By participating or, more precisely, by the first activity within the Contest (e.g. by posting a comment), the Contestant agrees to the related processing of personal data and these Terms and Conditions.
5.8. The Contestant is entitled to enter each Contest no more than once. In case of repeated participation, the Contestant shall be disqualified from the entire Contest.
5.9. Participation in the Contest applies to Contests that reward registered participants with an active ALIVE profile who have consented to receive selected information. Such Contests are held on the website or in the ALIVE App. By participating in the Contest, the Contestant agrees to these Terms and Conditions and acknowledges the related processing of personal data.
VI. Prize, winners, handover of Prizes
6.1. The Prize and the number of winners shall always be defined in the Abbreviated Rules.
6.2. The Prize shall be awarded to a specified number of Contestants who comply with the Abbreviated Rules and these Terms and Conditions.
6.3. The winners shall be determined or selected by a 3-member expert jury of GTS Alive based on the set criteria.
6.4. Each Contestant is only entitled to one Prize, unless otherwise provided in the Abbreviated Rules.
6.5. Participation in the Contest is non-repeatable, unless otherwise provided in the Abbreviated Rules.
6.6. Each Contest shall be evaluated within 14 (fourteen) days of its conclusion, unless otherwise provided in the Abbreviated Rules.
6.7. The winner shall be contacted to collect the Prize or to provide proof of compliance with the Terms and Conditions and the Abbreviated Rules within 14 (fourteen) days of the evaluation of each Contest.
6.8. In the event that the Contestant fails to respond to a call to collect the Prize or any other message from GTS Alive for a period of 3 (three) days, the Prize shall be forfeited to GTS Alive.
6.9. If the Contestant is unable to prove his/her identity upon collecting the Prize or meeting any other conditions under these Terms and Conditions, his/her entitlement to the Prize shall cease and the Prize shall be forfeited to GTS Alive.
6.10. Prizes shall be handed over in the following ways, as decided by GTS Alive:
6.10.1. The Prize shall be handed over in person at the venue.
6.10.2. The Prize shall be handed over in person at the registered office of GTS Alive.
6.10.3. Prizes shall be sent by post, in which case Prizes shall only be sent to addresses within the UAE.
6.11. Prizes that are not collected or picked up within 14 (fourteen) days of the winner being advised shall be forfeited to GTS Alive.
VII. Licences to the Contest Works
7.1. By submitting a Contest Entry (for the purposes of this article also referred to as a “Contest Work”), which is a work within the meaning of the applicable law, to the Contest, the Contestant grants GTS Alive a non-exclusive, royalty-free consent to use the Contest Work for all modes of use, in particular for publication on FB, Website, Contest website or other websites, communication channels or materials, and for advertising, promotional and marketing purposes of GTS Alive in the sense of dissemination and use of such copyright works in the media, to an unlimited extent (including unlimited territorial, material and quantitative scope), for the duration of the author’s proprietary rights.
7.2. GTS Alive is not obliged to use this licence and is entitled to adapt the Contest Works for its own purposes in accordance with the Copyright Act, as amended. If, within the meaning of the Copyright Act, the consent of the Contestant is required for any further use of the Contest Work (e.g. its modification, processing, translation, creation of a joint work, etc.), such consent shall be deemed to have been expressly granted by submitting the Contest Work to the Contest with the attached personal data. GTS Alive is entitled to provide a sub-licence and to assign this licence to third parties at its sole discretion.
7.3. By participating in the Contest and submitting a Contest Entry to the Contest, the Contestant expressly declares that he/she is authorised to grant these consents on behalf of the author of the Contest Entry. In the event that the contrary is proved during the Contest or at any time thereafter, the Contestant shall be fully liable for any damage or harm incurred by GTS Alive in connection therewith and undertakes to promptly indemnify or compensate GTS Alive for such damage in full. This means in particular that if any damage or harm (e.g. by imposing an obligation to provide compensation or imposing a fine) or costs are incurred by GTS Alive or any other person as a result of the lack of consent of the person concerned, the Contestant is obliged to indemnify or compensate GTS Alive or that other person for them in full.
7.4. The Contestant shall be fully liable to third parties in connection with the provision of the Contest Work and the grant of the licence, including third party claims asserted in conjunction with the provisions of the applicable law regulating and defining copyright, personal data protection, as well as other legal regulations. Each Contestant, by his/her participation, confirms in particular that the Contest Work submitted to the Contest is his/her original creation or that he/she has settled the rights of the author of the Contest Work on his/her own responsibility and at his/her own expense within the scope of the Terms and Conditions and the Abbreviated Rules, i.e. it is not an abuse of any copyright works. The Contestant also undertakes that the use of the Contest Work under these Terms and Conditions and the Abbreviated Rules will not affect any rights of third parties, i.e. the rights of persons mentioned or depicted in the Contest Work (i.e. personality rights), the rights of the owners of items or trademarks mentioned in the Contest Works, etc. All necessary consents related to the submission of the Contest Entry to the Contest must be handled by the Contestant at his/her own expense and on his/her own responsibility. In the event that it becomes apparent that the Contestant has infringed the rights of a third party, in particular copyright or personality rights, by his/her actions, the Contestant shall be fully liable for such infringement. The Contestant shall indemnify GTS Alive for any damage (or compensate GTS Alive for any harm) in the event of a breach of the licence conditions laid down herein, and shall also forfeit the right to the relevant Prize.
VIII. Processing of personal data and consent to disclosure of personal data
8.1. By participating in the Contest with reward for registered participants with an active Alive Profile who have consented to receive selected information and have been rewarded with the opportunity to participate in the Contest with reward, the Contestant acknowledges that the personal data provided by him/her will be processed by GTS Alive as the controller, including processing through the processors listed here. The terms of processing, the legal basis and all information about the processing of personal data are available in the Policy, specifically here.
8.2. In the event that the Contestant participates in a social media contest, the Contestant agrees that the personal data provided by him/her will be processed in accordance with the Terms and Conditions set out herein.
8.4. The Contestant expressly agrees that GTS Alive is entitled to use free of charge, in accordance with Federal Decree-Law No. 45 of 2019, as amended, the name, surname and town or city, as stated by the participants, in the media (including the internet), promotional and advertising materials of GTS Alive in connection with this Contest and its products and services, and that audio and visual recordings of the Contestants may also be made and published in the aforementioned manner for a period of 5 (five) years from the end of the Contest.
IX. Final provisions
9.1. By entering the Contest, all Contestants undertake to abide by these Terms and Conditions and the Abbreviated Rules. GTS Alive reserves the right to change the Terms and Conditions or the Abbreviated Rules or, as the case may be, to stop, interrupt or postpone the Contest.
9.2. Any disputes regarding compliance with these Terms and Conditions or their interpretation shall be decided by a 3-member committee consisting of GTS Alive employees. In the event of a dispute, the burden of proof shall always be on the Contestant.
9.3. These Terms and Conditions and the Abbreviated Rules are also available at the registered office of GTS Alive.
9.4. GTS Alive shall not be liable for loss, damage, destruction or non-delivery of the Prize notification or for loss, damage, destruction or non-delivery of the Prize itself due to reasons attributable to the Contestant or the postal service provider or other delivery agent. Contestants’ Prizes that cannot be delivered for reasons not attributable to GTS Alive shall be forfeited to GTS Alive.
9.5. If the Contest is organised via a social network, the Contestant is obliged to participate in the Contest exclusively via his/her own Alive Profile.
9.6. Contest Entries or any other comments must not contain pornographic, erotic or otherwise vulgar expressions, and they must also not contain racist or offensive language. Contest Entries must not be contrary to social morality and good manners.
9.7. GTS Alive reserves the right to change the Terms and Conditions or the Abbreviated Rules at any time. Any changes shall take effect upon their publication. A change to the Contest shall not entitle the Contestant to reimbursement of any costs incurred in the Contest. GTS Alive may, at its sole discretion, declare the Contest conducted to date void due to any technical or other system error. If, for any material reason that is likely to interfere with or otherwise adversely affect the administration, security, fairness, integrity and/or proper operation of the Contest, the Contest cannot proceed as scheduled, GTS Alive reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest.
9.8. GTS Alive shall not be liable for the inclusion of incorrect or inaccurate information in connection with the Contest (whether caused by human error or technical fault), nor for the completeness of extracts from these Terms and Conditions which may be published in abridged form in promotional materials, nor for printing errors.
9.9. GTS Alive shall not be liable for any technical or telecommunications difficulties or malfunctions arising during the Contest, the speed of the technical connection or any other deficiencies that may arise, including any failure to deliver electronic mail and any harm that may occur to the computer or other equipment of the Contestant or any other person in connection with participation in the Contest. GTS Alive shall also not be liable for any person being unable to enter or complete the Contest due to any technical failure or network congestion.
9.10. GTS Alive reserves the right to review all terms and conditions of participation in the Contest and, in the event of a dispute, to consider and finally decide on any claim, including the right to disqualify any Contestant in the event that such Contestant breaches the Terms and Conditions or the Abbreviated Rules or generally applicable law or is reasonably suspected of such activity.
9.11. GTS Alive advises that any deliberate attempt to damage any website or to interfere with the legitimate operation of the Contest may qualify as a breach of applicable law, may result in disqualification of the Contestant from the Contest and may also entitle GTS Alive to damages.
9.12. It is not possible to exchange Prizes or pay cash in exchange for in-kind Prizes, nor is it possible to claim participation in the Contest or Prizes through legal means.
9.13. GTS Alive reserves the right to retain without compensation any submitted Contest Entries, Contest Works, copyright works and other information, and to dispose of them at its sole discretion without compensation.
9.14. Please exercise maximum caution and diligently ensure the protection of your health and the health of all other persons present during the preparation and execution of all Contest-related activities and Contest Entries and during the creation of Contest Works. Do not perform any Contest-related activities alone. GTS Alive shall not be liable for any damage and/or harm caused as a result of the preparation or execution of any Contest-related activities, participation in the Contest or the Contest Prizes or in connection with them. The winner is not entitled to claim any additional entitlements from GTS Alive over and above the Prize awarded.
9.15. The results of the Contest are final, with no possibility of appeal. GTS Alive reserves the right to substitute Prizes with Prizes of a similar type and corresponding value and to change the terms and conditions of handover of the Prizes, in particular in the event that the Prizes are not provided by their supplier so that they can be delivered to the winners in accordance with the Terms and Conditions or the rules of a particular Contest.
9.16. This Contest is in no way sponsored or administered by or affiliated with the electronic social network Facebook or Instagram. Contestants understand that they are providing their information to GTS Alive and not to the electronic social network Facebook or Instagram.
9.17. By participating in the Contest, Contestants acknowledge that they have no legal claims against Facebook and Instagram, and that both Facebook and Instagram are fully exempt from any liabilities in connection therewith.
